Terms and Conditions Live Auction Bidding:
1. The Holzworth Auction Company, LLC. may refuse a buyer's number and bidding privileges to anyone for any reason.
2. The Bidder agrees to provide any requested identification, including, but not limited to, a driver's license, photocopies of credit cards, a Social Security card, or a US Passport.
3. Payments accepted: Cash, Credit or Debit Card with a 3% processing fee, Good Check, or Wire Transfer.
4. All items are sold "As Is, Where Is." The Auctioneer assumes no liability for any guarantee made by the seller.
5. The Auctioneer is not liable for any injury, damage, or loss incurred with the sale.
6. The Buyer assumes responsibility for items when they are "SOLD."
7. Statements made on the auction day precede previous written material.
8. All purchases must be paid in full before removal from the premises.
9. All Sales are FINAL. There are no refunds, exchanges, or refusals.
10. All property shall be removed from the premises by the Buyer at his/her own risk and expense within the time period announced.
11. Sales Tax rate: Colorado residents are required to pay a state sales tax of 2.9% on all items, except titled vehicles, on sale day, plus any city or county sales tax. Out-of-state purchasers are not required to pay these taxes. Colorado sales tax-exempt re-sellers must have a certificate on file with us prior to payment being received. If the primary use of purchases qualifies for the Colorado sales tax exemption for farm equipment used directly and primarily in for-profit farming, ranch or livestock production, or dairy farming for the production of raw milk, the Buyer may fill out an Affidavit for Colorado Sales Tax Exemption for Farm Equipment.
12. All checks $5,000.00 and over must be accompanied by a bank guarantee or letter of credit, unless known by the Auction Company.
Terms and Conditions Internet Bidding:
1. The Holzworth Auction Company, LLC. may refuse a buyer's number and bidding privileges to anyone for any reason.
2. Online bid submissions are a legal and binding contract. Under no circumstances will bids be edited or canceled. DO NOT bid if you DO NOT intend to purchase.
3. Anyone wishing to participate must register and provide a valid driver's license and credit or debit card number no later than 12:00 pm the day prior to the auction. In the event that early registration is not possible, the intended buyer must contact Ken Holzworth at 970-380-5305 or John Clatworthy at 970-768-7500 for other possible bidding arrangements.
4. If the intended total purchase amount exceeds $5000.00, a bank letter of credit must be on file with the office of The Holzworth Auction Company, LLC. before the beginning of the auction.
5. Before the auction, you will be contacted by phone by John Clatworthy, a representative of The Holzworth Auction Company, LLC., to verify that the Auction Company has received and approved the required documentation for you to participate in the Internet Auction.
6. If the Buyer is successful in purchasing any items, the total purchase price, including fees and tax, if applicable, must be wire transferred to The Holzworth Auction Company, LLC. and received by The Holzworth Auction Company, LLC., no later than the first business day following the auction at 3:00 pm MDT, regardless of the amount of purchase.
7. The Holzworth Auction Company, LLC. is not responsible for technical issues that may arise preventing the Buyer from placing a bid.
